1. Purpose

These terms of service ("Terms") govern access to and use of the FolioFinance service, available at foliofinance.fr, published by a natural person acting in a non-professional capacity (the "Publisher").

Creating an account constitutes full and unreserved acceptance of these Terms. Users who do not accept the Terms must refrain from using the service.

2. Description of the service

FolioFinance allows the user to:

The service is currently provided free of charge. The Publisher reserves the right to introduce paid plans; access to the features existing at the time a user signed up will not be restricted without thirty (30) days' notice.

3. Access to the service and account

Registration requires a first name, a last name, a valid e-mail address and a password. Providing a job title is optional.

The service is reserved for adult natural persons. It is not intended for minors under 15, and no registration of a minor under 15 is accepted.

The user is responsible for the confidentiality of their credentials and for any activity carried out from their account. They shall inform the Publisher without delay of any unauthorised use at contact@foliofinance.fr.

4. User obligations

The user undertakes not to publish content that:

Special care with embedded dashboards: by publishing a Power BI, Looker Studio, Tableau or Google Docs link, the user makes that content accessible to anyone who has the address of their portfolio. It is their responsibility to ensure that the data displayed is anonymised, fictitious, or that they have the right to disclose it publicly. The Publisher performs no verification of this content.

The user also undertakes not to massively extract content from the service, circumvent its technical limitations, or make unauthorised automated use of it.

5. Artificial-intelligence features

The service offers text analysis and rewriting features based on a language model operated by a third-party provider (Mistral AI). These features may be temporarily unavailable or disabled.

When the user activates these features, the relevant textual content is transmitted to this provider for the sole purpose of generating the requested suggestion. This content is not used to train models.

The suggestions produced are provided for guidance only. They may be inaccurate, approximate or inappropriate. The user remains solely responsible for the content they choose to publish. Use of these features may be subject to quotas.

6. Publication and removal

The user alone decides whether to publish or unpublish their portfolio, and may protect it with a password. Unpublishing makes the public address inaccessible; search engines may, however, temporarily keep a cached version, for which the Publisher is not responsible.

The Publisher may suspend or remove, without notice, any content that is manifestly unlawful or contrary to Article 4, and suspend the account concerned. The user is informed by e-mail and may contest the measure at contact@foliofinance.fr.

7. Ownership of content

The user retains all rights to the content they publish.

They grant the Publisher, for the sole duration of their use of the service and for the sole purposes of its operation, a non-exclusive, free and non-transferable licence to reproduce, store, technically adapt (resizing, compression, preview generation) and display this content. This licence ends upon deletion of the content or the account.

8. Availability

The service is accessible 24/7, subject to maintenance operations and incidents. No availability level is guaranteed under the free plan.

9. Liability

The Publisher is bound by a best-efforts obligation. It cannot be held liable in the event of:

Nothing in these Terms limits the Publisher's liability in the event of gross negligence, wilful misconduct, or infringement of rights the user holds under public-policy provisions.

10. Account deletion

The user may delete their account at any time from their account settings. Deletion results in the erasure of the account, the portfolio and the uploaded files under the conditions and within the timeframes set out in the Privacy Policy. This action is irreversible.

The Publisher may terminate an account that has been inactive for more than twenty-four (24) months, after prior notification by e-mail and a thirty (30) day period.

11. Changes to the Terms

The Publisher may amend these Terms. Any substantial change is notified by e-mail and displayed in the service at least fifteen (15) days before it comes into force. Continued use of the service after that date constitutes acceptance. Failing acceptance, the user may delete their account.

12. Applicable law and disputes

These Terms are governed by French law.

In the event of a dispute, the user is invited to contact the Publisher at contact@foliofinance.fr in order to seek an amicable solution. Failing agreement, the dispute shall be brought before the competent French courts. Consumers may bring proceedings before the court of the place where they reside.
